These Terms of Use (“Terms”) are an agreement between you and JInstant (“JInstant”, “we”, “us”) and govern your access to and use of the JInstantwebsite, accounts, and test-site service (together, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
JInstant lets you spin up free, temporary Joomla test sites for testing and evaluation. Test sites are isolated, short-lived environments intended for development, testing, and demonstration only. They are not a hosting product, and they are not intended for production websites, for storing important data, or for serving real traffic to the public.
Eligibility and accounts
You must be at least 16 years old (or the age of digital consent where you live) to use the Service. You are responsible for the activity that happens under your account and for keeping your sign-in details secure. Provide accurate information when you register, and let us know promptly if you suspect unauthorized use of your account.
Disposable, no-warranty environments
Test sites are disposable by design. Each test site and all of its contents are automatically and permanently deleted when it expires, and we do not keep backups. Do not store anything in a test site that you cannot afford to lose. We may change, suspend, recreate, or remove test sites at any time to operate or protect the Service.
Acceptable use
When using the Service, you agree that you will not:
- break the law, infringe others’ rights, or upload content you do not have the right to use;
- upload or distribute malware, or use a test site to attack, scan, or disrupt others;
- use the Service to send spam, mine cryptocurrency, run proxies or VPNs, or carry out any resource-abusive or unrelated workload;
- attempt to break out of a test site, access other users’ test sites or data, or interfere with the isolation and security of the Service;
- circumvent rate limits, quotas, expiry, or other technical restrictions, including by automating account or test-site creation;
- use the Service to host a production site or to serve a real audience.
We may suspend or terminate access, and remove content or test sites, if we believe these Terms are being broken.
Your content and responsibilities
You are solely responsible for the extensions, templates, code, and other content you upload to or create within a test site (“Your Content”), and for ensuring you have all rights and licenses needed to use it. You retain ownership of Your Content; you grant us only the limited permission needed to host and process it so we can provide the Service. Because test sites are deleted on expiry, you are responsible for keeping your own copies of anything you want to keep.
Third-party software and trademarks
The Service runs the Joomla!® content-management system and may let you install third-party extensions and templates. Joomla and those extensions are the property of their respective owners and are provided under their own licenses, which you are responsible for complying with. JInstant is an independent service and is not affiliated with, endorsed by, or sponsored by the Joomla! Project or Open Source Matters, Inc. “Joomla!” is a trademark of Open Source Matters, Inc.
Availability
The Service is provided free of charge on a best-effort basis. We do not promise that it will always be available, uninterrupted, or error-free, and we may add, change, limit, or discontinue features (or the entire Service) at any time without notice.
Disclaimer of warranties
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You use the Service at your own risk.
Limitation of liability
To the maximum extent permitted by law, JInstant and its operators will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the Service — including the loss or deletion of any test site or content. Because the Service is provided free of charge, our total liability for any claim relating to the Service will not exceed EUR 50 (or the equivalent in your local currency).
Indemnification
You agree to indemnify and hold harmless JInstant and its operators from any claims, damages, liabilities, and expenses arising out of your use of the Service, Your Content, or your breach of these Terms or of any law or third-party right.
Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access at any time if you breach these Terms, if it is needed to protect the Service or other users, or if we discontinue the Service. On termination, your test sites and account data may be deleted.
Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Service after changes take effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of Greece, without regard to its conflict-of-laws rules, and the courts located there will have jurisdiction over any disputes — except where mandatory local law gives you the right to bring proceedings elsewhere.
